On (date) ________________ this contract between Kjell Mathisen, born 020647, Sørstrandveien 103, N-4076 Vassøy, Norway, as owner, and (name) _____________________________________________ , (born) ________________ , (address) ______________________________________________________________________ _____________________________________________________________________ , as charterer, has been signed for a bareboat charter of S/Y Paradise, LK 8766, moored in Le Marin, Martinique, from (day/date) ________________ until (day/date) ________________ both dates included. | ||||||
| Point 1. If the return is delayed, an additonal cost will be charged to cover third party’s cost. It is however possible during the charter period to negotiate an aditonal number of days according to the charters need. | ||||||
| Point 2. The boat is to be examined by the charterer in accordance with the attached check lists which is to be completed and returned to the owner in order to confirm the contract. The charterer may decline to accept the vessel as is after the inspection, and also demand faults/defects corrected. The contract is confirmed when the charterer singes the check lists as accepted. A crewlist, completed with names, addresses, passport numbers, dates of birth and emergency telephone numbers to next of kin, is to be delivered together with the check lists. | ||||||
| Point 3. This contract is validated for both parties the moment the charterer has paid an amount equivalent to NOK 15 000 to bank account 3201 10 26027 in Sparebank #1, SR-Bank, Stavanger, Norway latest thirty - 30 - days before the above mentioned charter period commences. The remaining amount, (equivalent to NOK 3 000) is to be paid cash in Euro at the moment of acceptance of the boat. In addition the charterer is to deposit Euro 1 000 - one thousand - in cash to the owner or his representative. The amount is to be returned untouched when the vessel is returned unharmed. | ||||||
| Point 4. By signing this contract, the charterer signs that he/she is well familiar with what the insurance cover/does not cover through the agreement with Pantænius Yacht Assurandør, the insurance’s limitations and the charterer and his/her crew’s duties, including the owner’s part to be paid if harm to the yacht demands that the incurance is to be activated. The charterer may be responsible for this amount it carelessness from the charterer or anyone in his/her party is the cause for the damage. The charterer is also responsible for avoiding the vessel to be brought into situations like breaking any of the visiting countries’ laws, including violating laws against fishing, under water activities, to seek and/or take possession of objects of archaelogical nature or value, anchoring, collisions, damage to persons or to property causing the vessel to be subject to the authorities’ right to withhold the vessel. Should a situation neccessitate a tow by another vessel, the skipper must negotiate and agree with the captain of the other vessel on the price to be paid in such a manner that the towing vessel’s owner cannot afterwards demand to be compensated salvation pay. With the exeption of danger for anyones life or destruction of another vessel, the S/Y Paradise is not permitted to tow any other vessel. | ||||||
| Point 5. If damage to the vessel due to neglect from the owner, or due to normal wear and tear, occur which prevent her from being manuvered, driven through the water with speed, or have the charterer and his party on board in normal comfort, the charterer and his/her party shall not suffer. The owner shall provide acceptable replacement for S/Y Paradise if the damage cannot be repaired within one to two days. The owner shall financially compensate the charterer for loss of days. | ||||||
| Point 6. In case damage mentioned in Point 5. is caused by the charterer or members in his/her party, the charterer must seek to have the damage completely recovered and repaired, or replaced, at his/her cost. Lost or damaged items accepted by the charterer on the check lists, shall be replaced at the charterer’s cost. | ||||||
| Point 7. If no other agreement has been established in writing, the vessel shall be returned to Le Marin, Martinique, and be controlled together with the charterer by one of the owners representatives. The amount of fuel and freshwater on board at the beginning of the charter, is to be on board by the return. Normally this means all tanks full. | ||||||
| Point 8. The vessel’s log must be recorded daily. In additon the position and condition is to be sent the owner on email or by cell phone daily, or as soon as cell phone coverages provides that a message can be sent. Sample: Arrived St. Lucia today. All well! | ||||||
